Smart Energy Enterprises (AKA SEE Inc.) will not share any personal identifiable information with third parties' for direct marketing purposes unless you affirmatively agree to the disclosure. We keep your personal information private and secure. When you make a purchase from our site, you provide your name, email address, credit card information, address, phone number, and a password. We use this information to process your orders, to keep you updated on your orders and to personalize your shopping experience. Your participation and activity (including providing the information noted above) is voluntary, and you can choose not to provide certain information, however you may not be able to take advantage of some of the Web Site’s features; including purchases. When entering any of our contests or prize drawings, you provide your name, email address and mailing address. If you win, we will send the prize to the address entered and notify you by email. When you enter a contest or drawing you are also included in our newsletter list to receive notice of promotions, specials and new additions to the Smart Power Drinks site. You may unsubscribe from this news list by following the unsubscribe instructions in any email received.

Smart Energy Enterprises may also receive information about you from other sources in connection with promotions, contests, sweepstakes, affiliates, or special purchases in connection with a promotion in which Smart Energy Enterprises is participating that is offered on a third-party site. Said information may be combined with the information we collect on the SEE Inc. website. In those cases, SEE Inc. will apply this Privacy Policy to any personally identifiable information received. In other words we will not share your information.

Smart Energy Enterprises uses a fulfillment center for the handling, packing and shipping of its orders and the following information will be transmitted electronically via email to complete the order:  Name, phone number, email address, shipping address and billing address and product (s) ordered. 

We use "cookies" to keep track of your current shopping session to personalize your experience and so that you may retrieve your shopping cart at any time.

Children

Smart Energy Enterprises does not want to collect personal information from minors (children under 13 years of age, or any other age defined under applicable law). If we become aware that a minor is attempting to or has submitted personal information via this Web site, we will notify the user that we may not accept his or her personal information. We will then expunge any such personal information from our records.

Eligibility for Service or products

Our services are eligible and available only to individuals who are of legal age to form legally binding contracts under each applicable state law. If you do not qualify, please do not use our services.  Any Giveaway is limited to people 18 years of age or older.

Order Acceptance Policy

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Smart Power Drinks reserves the right at any time after receipt of your order to accept or decline your order for any reason or to supply less than the quantity you ordered of any item.

Credit Cards

We accept the following credit cards: Visa, MasterCard, and Discover. There is no surcharge for using your credit card to make purchases with Smart Power Drinks. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order. Your credit card will be billed upon shipment of your order.

Money Orders, Cashier’s Checks, Company Checks, & Personal Checks

Smart Power Drinks accepts money orders, cashier’s checks, personal checks, and company checks in U.S. Dollars only. Orders are processed upon receipt of a money order or cashier’s check. For personal and company checks, please allow up to 10 banking days after receipt for clearance of funds before the order is processed. We cannot guarantee the availability of a product by the time funds clear or payment is received. We will charge a $25 fee on all returned checks.

Shipping Policy

Because we want you to have the best experience in receiving your Smart Energy drink product we have selected a major shipping carrier with great dependability and we will ship your order via FedEx.  Said delivery is shipped via ground service in the Continental US only.  Shipping may not be available in all areas and it subject to the delivery limitation of FedEx.  Any shipments with special handling costs associated with the shipping address may result in higher charges solely at the expensive of the customer.

Shipping Charges For Delivery Exceptions

FedEx Delivery Exceptions (wrong addresses):   Customer agrees to pay additional fee of $5.50 per delivery exception (wrong or incorrect shipping address) if said information is provided in error by customer.   Customer will be invoiced separately by SEE Inc. either directly or through a Paypal invoice.  Customer is not responsible for delivery exceptions caused by SEE Inc.  Package will be delivered upon payment of delivery exception fee.

Shipping Time

Most orders received before 2:00PM PST will ship the same day, provided the product ordered is in stock. Most orders received after 5:00 PM will ship the next business day. Orders are not processed or shipped on Saturday or Sunday, except by prior arrangement. All orders must be shipped to physical business or residential addresses. FedEx will not ship to any P.O. Boxes. Your order may be cancelled if the shipping address is incorrect. We cannot guarantee when an order will arrive. Consider any shipping or transit time offered to you by Smart Power Drinks or other parties only as an estimate. However Smart Energy Enterprises ships its products via FedEx Ground with an expected delivery within 5 business days. We encourage you to order in a timely fashion to avoid delays caused by shipping or product availability.

Out-of-Stock Products

We will ship your product as it becomes available. Usually, products ship the same day if ordered by 2:00PM , or by the next business day if your order is received after this time and for orders received on Saturday, Sunday or any major holiday. However, there may be times when the product you have ordered is out-of-stock which will delay fulfilling your order. We will keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment. You may cancel your order at any time prior to shipping.  Products, services and materials are provided on an “as available” basis and your order may be accepted or declined at any time for any reason.     

Multiple Product Orders

For a multiple product order, we will make every attempt to ship all products contained in the order at the same time. Products that are unavailable at the time of shipping will be shipped as they become available, unless you inform us otherwise. You will only be charged for products contained in a given shipment, plus any applicable shipping charges. You will only be charged for shipping at the rate quoted to you on your purchase receipt. The entirety of this shipping charge may be applied to the first product(s) shipped on a multiple shipment order.

Taxes

Smart Power Drinks shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within CA. For orders shipped to other states, you are solely responsible for all sales taxes or other taxes.

Changes
Smart Energy Enterprises, Inc. reserves the right to modify its services or products at any time by changing this Agreement or other information on our Site. This includes the right to discontinue the site services or products, change the rules of use, and terminate your use. Smart Energy Enterprises, Inc. does not guarantee continuous, uninterrupted access to our services or products, and operation of our Site may be interfered with by numerous factors outside of our control.  Smart Energy Enterprises may change the terms of use from or policies at any time for any reason.  We will post those changes on our site and encourage users to read the “Terms Of Use” page frequently. 

Returns

We will gladly accept the return of products that are either defective due to defects in manufacturing and/or workmanship, or otherwise do not meet your standards for a high-quality product, for 30 days from the date of purchase. Fulfillment mistakes that we make resulting in the shipment of incorrect product to you will also be accepted for return 30 days from the date of purchase. Please return any unused product with sales receipt and we will refund you for your purchase.   Any charges for shipping are not refundable. Our return refund is for products purchased directly through our online store only.  All other refunds must be obtained directly from the original store where the product was purchased and are subject to that store’s refund policy.

How to obtain a refund

Please call customer service at 707-745-4569 ext 701  or  email: customerservice[at]smartpowerdrinks.com in advance to obtain an RMA number (Return Merchandise Authorization) within 30 days of purchase date. We must receive the product no more than 45 days after the original purchase.

 - Today’s Date
 - Product You Are Returning
 - The Date You Purchased The Product Online or Order Number

NOTE: RMA NUMBER MUST BE ON EXTERIOR OF BOX.  Please put sales receipt and any other information inside box. Please repack with adequate packing to prevent rattling.  Returns sent without a RMA number will be returned to sender.

We suggest you return the product using a service that offers tracking.  We are not responsible for lost return items or their postage.

Typographical Errors

In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Smart Power Drinks shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Smart Power Drinks shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Smart Power Drinks shall immediately issue a credit to your credit card account in the amount of the incorrect price
